## TL;DR

- **DO** use MangaBaka for personal, non-commercial manga tracking and discovery.
- **DO** respect other users, contribute accurate metadata, and follow the community guidelines.
- **DO** keep your account credentials private. Never share PATs, OAuth tokens, or passwords.
- **DO NOT** scrape the website. Use the [API](/api) or [database download](/database) instead, and follow the [Data License](/about/data-license).
- **DO NOT** create multiple accounts to manipulate votes, ratings, or evade bans.

## 1. Introduction

Welcome to MangaBaka. These Terms of Service ("Terms") govern your access to and use of the MangaBaka website at mangabaka.org, the MangaBaka API at api.mangabaka.dev, and all related services, features, and content (collectively, the "Service"). The Service is run by the MangaBaka community project ("we", "us", "our"). MangaBaka is not a registered company or legal entity. It is an open community project managed through [OpenCollective](https://opencollective.com/mangabaka/donate?interval=month).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

These Terms apply to all users of the Service, whether registered or unregistered. Additional terms may apply to specific features:

- **Data License**: Governs API access and data licensing. See [Data License](/about/data-license).
- **NonCommercial Terms**: Clarifies commercial use definitions. See [NonCommercial Terms](/about/data-license-noncommercial).
- **Contribution Terms**: Governs user-submitted metadata contributions. Accepted in-app before contributing.
- **Acceptable Use Policy**: Governs community conduct. See [Acceptable Use Policy](/about/acceptable-use).

## 2. Definitions

**"Content"** means all text, data, images, metadata, tags, reviews, comments, lists, ratings, and other material available through the Service, including both MangaBaka Content and User Content.

**"MangaBaka Content"** means the Service itself: site design, logos, software, and branding. For the data within the Service (metadata, tags, identifiers, etc.), see "MangaBaka Data" as defined in the [Data License](/about/data-license), which is licensed under CC BY-NC-SA 4.0.

**"User Content"** means Content created or submitted by users of the Service, including: comments, ratings, library entries, reading lists, reviews, metadata contributions, tags, and profile information.

**"Third-Party Data"** means Content originating from external metadata providers, as defined in the [Data License](/about/data-license).

## 3. Accounts

### 3.1 Registration

Certain features of the Service require you to create an account. You may register directly or through a supported third-party authentication provider (including Discord, AniList, Google, Microsoft, GitHub, GitLab, Naver, and Kakao).

When creating an account, you must:

- Provide accurate and complete information.
- Be at least 13 years of age, or the minimum age required by the laws of your jurisdiction, whichever is greater.
- Not create an account on behalf of another person without their authorization.
- Not create multiple accounts for the purpose of evading bans, manipulating votes, or circumventing any restrictions.

### 3.2 Account Security

You are responsible for maintaining the security of your account credentials. You must not share your password, session tokens, personal access tokens (PATs), or OAuth credentials with any third party.

You are solely responsible for all activity that occurs under your account. If you become aware of unauthorized access to your account, please [contact us](/about) immediately.

### 3.3 Account Linking

You may link multiple third-party authentication providers to a single MangaBaka account. Linking an account does not grant MangaBaka access to your data on those platforms beyond what is required for authentication.

### 3.4 Account Termination

You may delete your library entries, lists, and other user-generated content at any time through the Service. Full account deletion is not yet available as a self-service feature. Contact us to request manual deletion. Upon account deletion:

- Your profile and personal information will be removed.
- Your library data and private lists will be deleted.
- User Content you have contributed (comments, ratings, metadata contributions) may be retained in anonymized form where it has been incorporated into the Service.

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms, the Acceptable Use Policy, or for any other reason at our discretion. We will make reasonable efforts to notify you of the reason for suspension or termination, except in cases of severe or repeated violations.

## 4. Use of the Service

### 4.1 License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

### 4.2 Prohibited Conduct

You agree not to:

- Use the Service for any unlawful purpose or in violation of any applicable law.
- Violate the [Acceptable Use Policy](/about/acceptable-use).
- Interfere with or disrupt the Service, its servers, or networks connected to the Service.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service.
- Use automated means (bots, scrapers, crawlers) to access the Service except through the MangaBaka API or database downloads in compliance with the [Data License](/about/data-license).
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
- Circumvent any rate limits, access controls, or security measures.

### 4.3 API Access

Access to the MangaBaka API and database downloads is governed by the [Data License](/about/data-license). API and database download users must also comply with these Terms and the Acceptable Use Policy.

Personal Access Tokens (PATs) and OAuth credentials are issued for your use only and must not be shared, sold, or transferred to third parties.

## 5. User Content

### 5.1 Responsibility

You are solely responsible for all User Content you create, upload, or submit through the Service. You confirm that:

- You have the right to submit the User Content.
- Your User Content does not infringe the intellectual property or other rights of any third party.
- Your User Content complies with these Terms and the Acceptable Use Policy.

### 5.2 License Grant

By submitting User Content to the Service, you grant MangaBaka a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content to operate, develop, and improve the Service.

For metadata contributions (tags, series edits, cover images, synopses, and similar editorial content), the Contribution Terms accepted in-app apply. Metadata contributions are licensed under CC BY-NC-SA 4.0 and this license is irrevocable.

For other User Content (comments, ratings, library entries, lists), you retain ownership of your content. However, the license granted above is perpetual and irrevocable. Once submitted, MangaBaka may continue to use, display, aggregate, and build upon your User Content even if you later delete it or your account. This includes using User Content in aggregated or anonymized form for trends, statistics, research, and improving the Service. If you delete your content, we will make reasonable efforts to remove it from public-facing views, but it may persist in aggregated datasets, backups, caches, or where it has been shared or referenced by other users.

### 5.3 Content Removal

We reserve the right to remove or modify any User Content at our discretion, for any reason, including: violation of these Terms, the Acceptable Use Policy, or in response to valid legal requests.

We are not obligated to monitor User Content, but we may do so at our discretion.

## 6. Intellectual Property

### 6.1 MangaBaka Content

The Service, including its design, software, logos, and MangaBaka Content, is owned by MangaBaka and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from MangaBaka Content except as expressly permitted by these Terms or the [Data License](/about/data-license).

### 6.2 Third-Party Data

Third-Party Data displayed through the Service remains the property of its respective owners. MangaBaka does not claim ownership of Third-Party Data. Your use of Third-Party Data is subject to the terms of the original provider as described in the [Data License](/about/data-license).

### 6.3 Name and Branding

The name "MangaBaka", the MangaBaka logo, and related visual identity are claimed as common law marks of the MangaBaka project. While not formally registered as trademarks, we assert our rights through continuous public use. You may not use these marks in a way that implies endorsement by or affiliation with MangaBaka, except to accurately reference the Service with appropriate attribution.

### 6.4 Copyright Claims

We respect the intellectual property rights of creators and publishers and follow the DMCA takedown process. If you believe that content available through the Service infringes your copyright, please see our [DMCA Policy](/about/dmca) for the full procedure and requirements, or send a takedown request to `dmca@mangabaka.org`.

## 7. Data Import and Export

### 7.1 Import

The Service allows you to import library data from third-party platforms (including AniList, MyAnimeList, and MangaUpdates). By importing data, you represent that you have the right to transfer that data and that the import does not violate the terms of the originating platform.

MangaBaka is not responsible for the accuracy or completeness of imported data.

### 7.2 Export

You may export your library data from MangaBaka at any time through the available export features. Exported MangaBaka Data is subject to the CC BY-NC-SA 4.0 license. Exported data that includes Third-Party Data remains subject to the terms of the original provider.

## 8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

## 9. Third-Party Services

The Service integrates with third-party services for authentication, metadata, and other functionality. We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party services through MangaBaka is subject to those services' own terms and privacy policies.

## 10. Disclaimer of Warranties

The Service is provided **"as is"** and **"as available"** without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.

We do not warrant that:

- The Service will be uninterrupted, error-free, or secure.
- Content available through the Service is accurate, complete, or current.
- Defects will be corrected in any particular timeframe.

## 11. Limitation of Liability

To the maximum extent permitted by applicable law, MangaBaka and its contributors and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or other intangible losses, arising out of or related to:

- Your use of or inability to use the Service.
- Any Content obtained from or through the Service.
- Unauthorized access to or alteration of your data or transmissions.
- Any conduct of third parties on or through the Service.

## 12. Indemnification

You agree to indemnify, defend, and hold harmless MangaBaka and its contributors and volunteers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

- Your use of the Service.
- Your User Content.
- Your violation of these Terms or the Acceptable Use Policy.
- Your violation of any third-party right, including intellectual property rights.

## 13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

## 14. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be indicated by updating the "Last Updated" date at the top of this document. Material changes will be announced through the Service.

Your continued use of the Service after changes are posted means you accept of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.

## 15. Governing Law

These Terms are governed by the laws of Denmark, without regard to its conflict of law provisions. Any disputes arising under these Terms will be resolved in the courts of Copenhagen, Denmark.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

## 17. Entire Agreement

These Terms, together with the [Data License](/about/data-license), [NonCommercial Terms](/about/data-license-noncommercial), Contribution Terms (presented in-app at the time of contribution), [Acceptable Use Policy](/about/acceptable-use), and [Privacy Policy](/about/privacy), constitute the entire agreement between you and MangaBaka regarding the Service.
